1. Introduction

2. Scope of This Manual
This manual has been prepared in respect of the following South African entities:
- Dargells Engineering & Machinery Sales (Pty) Ltd
- Gartech Equipment (Pty) Ltd
- EGA Engineering and Plastics (Pty) Ltd
3. The Promotion of Access to Information Act (PAIA)
The Promotion of Access to Information Act, No. 2 of 2000 (“the Act”), was enacted on 3 February 2000. The Act gives effect to the constitutional right of access to:
- Information held by Government; and
- Information held by another person that is required for the exercise or protection of any rights.
This right is entrenched in the Bill of Rights of the Constitution of South Africa.
Where a request is made in terms of the Act, the body to which the request is made is not obliged to release the information except where the Act expressly provides that the information may or must be released. The Act also sets out the procedural requirements relating to such requests.
4. Purpose of the Manual
To promote effective governance of private bodies, it is important that individuals understand and are able to exercise their rights in terms of the Act.
Section 9 of the Act recognises that the right of access to information is not unlimited and may be subject to justifiable limitations, including:
- Protection of privacy
- Commercial confidentiality
- Effective, efficient and good governance
These limitations must be balanced with other rights contained in the Bill of Rights of the Constitution.
Throughout this manual, any reference to the **“Private Body”** refers to Dargells Engineering & Machinery Sales (Pty) Ltd and all associated entities for which this manual has been prepared.

6. South African Human Rights Commission Guide
The South African Human Rights Commission (SAHRC) has compiled the guide contemplated in Section 10 of the Act. The guide contains information that may reasonably be required by any person wishing to exercise rights contemplated in the Act.
